What Is SB 721 in California?

The State of California has enacted Senate Bill No. 721 (SB 721), a law that imposes stringent inspection requirements on multifamily buildings. As per the stipulations of SB 721, owners of buildings with three or more units are obligated to conduct periodic inspections. The purpose of these inspections is to ensure the structural integrity and safety of balconies, decks, and stairs, which are categorized as Exterior Elevated Elements (EEE).

What Is the Timeline for SB721?

This law was approved in September 2018 and mandates that all relevant inspections must be completed by January 1st, 2026. The inspection report, which needs to be submitted within 45 days of the property inspection, must clearly define the current condition of the EEE, specify the expected service life of the elevated element, and clarify expectations for maintenance and repairs.

Below are additional key requirements of SB 721:

All safety inspections must be performed by individuals who are qualified under provisions of SB721.
The property owner must correct any problems which require repair or replacement.
The inspector must inspect at least 15% of each type of elevated element during the inspection; they are responsible for determining which features to examine.
Property owners must schedule re-inspections every 6 years.

Under SB 721, buildings required to have deck inspections include multifamily residential properties with three or more dwelling units.
